AGREEMENT BETWEEN
THE CONSEJO NACIONAL DE ATENCIÓN Y PROTECCIÓN INTEGRAL A LA NIÑEZ Y LA ADOLESCENCIA
 AND THE INTER-AMERICAN CHILDREN’S INSTITUTE

The Executive Secretary of the Consejo Nacional de Atención y Protección Integral a la Niñez y la Adolescencia (National Council for Child Integral Care and Protection), Ana María Aguirre de Gutiérrez and the Director General of the Inter-American Children’s Institute, Piero Solari Zerpa hereby sign this Agreement as per the following terms and conditions:

CONSIDERING:

Article 1

That the Inter-American Children’s Institute (hereinafter “the IIN”) is a Specialized Organization of the Organization of American States (hereinafter the “OAS”)  that was created in 1924 through a resolution adopted by the Fourth Pan American Child Congress and formally established in 1927 for the purpose of promoting cooperation programs among the countries in the Americas aimed to improving, among other aspects, the situation of children and the family on development issues and social, cultural, and legal areas;

Article 2

That the Consejo Nacional de Atención y Protección Integral a la Niñez y la Adolescencia (hereinafter “CONAPINA”) was established as mandated in Article No. 62, Title II, Volume II in the Child Code and organized by Law No. 351 as the highest governing body responsible for enforcing in all its actions the principles of child best interest, equality, non discrimination, protection, integral education and participation provided for in the International Convention on the Rights of the Child and the Child Code;

Article 3

That the Republic of Nicaragua ratified the United Nations Convention on the Rights of the Child;

Article 4

That during the last decade CONAPINA developed a series of joint actions with the IIN, including the establishment at its headquarters of the National Child and Family Information Center (processing information on organizations, projects and documents on children’s rights, particularly in the region) and the Site for Child-related Action Coordination; 

Article 5

That the IIN has developed a set of tools for promoting the availability of information on children’s rights, addressed to both children themselves and those who work with them;

Article 6

That among the products developed the following should be noted: animated videos (performed by singers from various countries in the region) currently broadcasted by more than 100 open and cable TV channels in the region, digitalized books for children related to their rights, and interactive videogames on children’s rights, and

Article 7 

That following IIN negotiations supported by the OAS General Secretariat, the Ambassador of the Republic of Korea to the OAS has informed on its country’s willingness to donate computer equipment —one or two at the most— for each center managed by CONAPINA,  

The Parties agree: 

CLAUSE 1 - OBJECTIVE 

The objective of this Agreement is to set the grounds for the establishment and use of computers for educational purposes and for disseminating the Convention on the Rights of the Child.  

CLAUSE 2 - TERMS 

Article 1 

The IIN, through the Republic of Korea, will make available to CONAPINA 60 Pentium IV computers with speakers, screens, MODEM, and CD-ROM/DVD readers, to be delivered in Nicaragua.

Article 2 

The IIN will be responsible for providing the package of educational tools digitally developed by the Institute to be installed in the equipment and used by the centers, as determined by CONAPINA and reported accordingly to the IIN.  

Article 3 

CONAPINA will be entitled to incorporate into the equipment any educational-IT modules as deemed convenient for pursuing the objective of this Agreement and developing children’s capabilities, and will inform the IIN accordingly.

Article 4 

CONAPINA will be responsible for the receipt, proceedings required, and adequate transfer, installation, use, and maintenance of the equipment, and such aspects should be ensured for the whole duration of this Agreement.  

Article 5 

Within the first six months after installing the equipment CONAPINA will assess the impact of this donation and will inform the IIN accordingly.

Article 5 

CONAPINA hereby assures that the IT equipment as well as any incorporated technology will be exclusively used for the purposes provided for in this Agreement. 

Article 6          

CONAPINA will disseminate these actions developed by the IIN in its capacity as a specialized organization of the OAS and by the Government of the Republic of Korea.  

CLAUSE 3 – FINAL PROVISIONS 

This Agreement will enter into force upon its signing and its duration will be twenty-four (24) months.  

IN WITNESS THEREOF, the representatives of both Parties, duly authorized for this purpose, sign this Agreement in two equally valid copies on the thirtieth day of March, 2006.  

The Director General of the IIN signs ad referendum of the Directing Council of the IIN.
