WHEREAS: The Inter-American Children's Institute and the Colombian Institute for
Family Welfare signed an Agreement on May 9, 2001. The Inter-American Children's Institute, through its Inter-American Child
and Family Information Program, has developed an Inter-American Network of
Information Centers with regional coverage and more than 70 active
information centers. This Program operates three databases: a database of documents, which
currently contains more than 80,000 documents on children’s rights; a
database of organizations listing more than 11,000 organizations; and a
database of projects that includes more than 1,500 projects related to
children's rights. THEREFORE: The Colombian Institute for Family Welfare (hereinafter known as the ICBF)
and the Inter-American Children's Institute (hereinafter known as the IIN)
hereby agree to establish a National Child and Family Information Center,
which will be a focal point of the RIIN network acting as the Coordinating
Center of Colombia’s National Child and Family Information Network. CLAUSE ONE
Objectives
The objectives of this Center (the first step in the National Network)
shall be: ARTICLE 1.
To compile, select and systematize all of the information and
documentation produced in Colombia on children, adolescents and the family
as regards legal affairs, social issues, education, prevention of drug
abuse, and health, with the Convention on the Rights of the Child as the
framework of reference. ARTICLE 2.
To compile, select and systematize all of the reference information on
institutions, projects and events relative to the subjects mentioned in
Article 1. ARTICLE 3.
To disseminate, in Colombia, information on children and the family
generated in the country, information obtained from the rest of the
Americas through the IIN, and documentation external to the Inter-American
System which directly or indirectly contributes to improving the quality
of life of Colombian children and families. ARTICLE 4.
To send, to the IIN Information and Coordination Center (hereinafter known
as the CIC), the information and documentation compiled by the Center, on
a periodical basis, in order to update the common databases and to make
this information and documentation available to all the System’s users
in the region. ARTICLE 5. To provide copies of the original documentation to users in Colombia and
the RIIN Network in the rest of the region, based on the mechanisms
established by mutual agreement with the IIN. CLAUSE TWO
Terms of the Agreement
ARTICLE 1.
The IIN shall provide the ICBF with a “User’s License” for the OPD
System which has been specially programmed by the IIN, as well as the
related documentation. ARTICLE 2.
The IIN shall provide the training, instruction and technical support
necessary for the proper operation of the Center. ARTICLE 3.
The ICBF shall provide the appropriate infrastructure for the operation of
the Center, as well as the necessary furnishings and equipment (computer,
photocopier) for the fulfillment of the objectives sought by the ICBF and
IIN in the present Agreement. ARTICLE 4.
The ICBF shall be responsible for finding personnel to ensure the proper
operation of the Center, as the depository of the computer software and
all the information on children and the family contained in the OPD System. ARTICLE 5. The ICBF shall bear the costs of installation, training and maintenance
of the Center, to create conditions that ensure its operation beyond the
first 24 months. ARTICLE 6.
The ICBF may create a National Network based on the Center in the rest of
the cities of Colombia. To this end, it may sign agreements with the
institutions of its choice, and the present Agreement shall be extended to
said institutions in all of its terms, except for the provision regarding
support and maintenance of the computer software, which in these cases
shall be the responsibility of the ICBF. ARTICLE 7.
The ICBF shall report Center-related activities, as well as the creation
of new nodes, to the IIN. ARTICLE 8.
The ICBF shall not transfer the computer software or the associated
documentation to third parties, nor sell, in whole or in part, the
information contained in the OPD System. ARTICLE 9.
Twice a year, the ICBF shall generate, publish and distribute the five
series of the Bibliographical Journal for Center users. ARTICLE 10. Once a year, the ICBF will produce the Yellow Pages on Children and a
Directory of Projects for distribution among users in Colombia. ARTICLE 11. The ICBF shall be responsible for all of the information that is
entered into the system in Colombia. The ICBF shall be free of any
responsibility for the rest of the information entered into the system by
other National Centers, nodes, or the CIC itself. ARTICLE 12. The ICBF may include advertisements in the Bibliographical Journals and
Directories, which must be approved by both parties before their
publication. Said advertisements must be consistent with the character and
purposes of the Organization of American States and the IIN. ARTICLE 13. The ICBF may copy or transfer the information contained in the system
for use in its own databases. ARTICLE 14. The ICBF shall use an
Internet connection for the purposes of e-mail, e-conferencing and access
to the databases, permitting a fluid exchange of information with the
other Centers of the Inter-American Child and Family Information Program (PIINFA)
and allowing user institutions to access online query services. ARTICLE 15. The ICBF shall ensure the
continuity of the human and material resources assigned to this project,
so that they will be able to fulfill the commitments derived from the
present agreement. CLAUSE THREE
Final Provisions
The present Addendum shall enter into force upon its signature by the
parties, and shall be valid for a period of 24 months, renewable following
evaluation by the IIN. The first renewal shall be expressly agreed;
subsequent renewals shall be automatic, each for a period of 24 months. This Agreement shall be rescinded at the request of one of the parties,
with notification 90 days in advance. In the event of rescission, the
Information Center shall cease to be authorized to use the programs and
databases, and shall return them to the IIN. Changes to the terms of the
present Agreement may be made with the specific consent of both parties. The present Agreement is signed by Dr. Beatriz Londoño Soto, and Lic.
Alejandro Bonasso Lenguas, Director General of the IIN, on an ad-referendum
basis pending approval by the Directing Council of the Inter-American
