AGREEMENTS SIGNED BY THE OFFICE OF THE DIRECTOR GENERAL
 
(Submitted by the Delegation of Argentina)  

THE DIRECTING COUNCIL,

HAVING SEEN:

  1. The nine agreements detailed in document CD/doc.15/06 of this Meeting that were signed by the Office of the Director General ad referendum of the Directing Council in accordance with its powers and conferred by the IIN Statute;
  1. The annexed observations made by the Working Group composed of the Delegates of Barbados, Paraguay and Uruguay;

CONSIDERING:

That the above mentioned agreements are framed within the action policies of the Inter-American Children’s Institute adopted by the Directing Council and within the IIN Strategic Plan for 2005-2008;

 

RESOLVES: 

  1. To ratify the nine agreements signed by the Inter-American Children’s Institute with the respective counterparts as detailed in document CD/doc.15/06 of the 81st Regular Meeting of the Directing Council.
  1. To inform the Office of the Director General on the observations made by the Working Group responsible for reviewing the Agreements contained in Annex 1 and request that such observations be taken into account when signing future agreements.
  2. To request the Working Group the inclusion in the Report submitted to the Plenary on the Agreements signed ad referendum by the Office of the Director General of the objectives of each Agreement and their consistency with the IIN Strategic Plan.

 

Annex 1

WORKING GROUP FOR REVIEWING THE COOPERATION AGREEMENTS (CD/doc. 15/06) 

The Working Group for reviewing the Cooperation Agreements analyzed the following nine documents signed by the Director General of the Inter-American Children’s Institute or whoever was in charge of its Office, ad referendum of the Directing Council:  

1.      Agreement between the “Directorate of Gender Affairs, Ministry of Labour, Public Administration and Empowerment (DOGA)” of Antigua and Barbuda” and the Inter-American Children’s Institute.  16 September, 2005 

2.      Agreement between “The University of West Indies” of Jamaica and the Inter-American Children’s Institute. 19 September, 2005 

3.      General Cooperation Agreement between the Consejo Nacional para la Niñez y la Adolescencia (CONANI) of the Dominican Republic and the Inter-American Children’s Institute. 21 October, 2005 

4.     General Cooperation Agreement between Save the Children – Sweden and the Inter-American Children’s Institute. 10 March, 2006 

5.      Agreement between the Consejo Nacional de Atención y Protección Integral a la Niñez y la Adolescencia (CONAPINA) of Nicaragua and the Inter-American Children’s Institute. 30 March, 2006 

6.      General Cooperation Agreement between the Inter-American Centre against Disappearances and Trafficking of Persons (CIDETT) of Peru and the Inter-American Children’s Institute. 5 April, 2006 

7.      General Cooperation Agreement between Defence for Children International in Costa Rica and the Inter-American Children’s Institute. 26 April, 2006 

8.      General Cooperation Agreement between The Hague Conference on Private International Law and the Inter-American Children’s Institute. 11 June, 2006 

9.      Cooperation Agreement between Save the Children Sweden and the Inter-American Children’s Institute. 6 July, 2006  

The Working Group for reviewing the Agreements made the following observations:  

1.      Comments on the Spanish version of the Agreements  

Agreement no. 1 with the “Directorate of Gender affairs, Ministry of Labour, Public Administration and Empowerment (DOGA) of Antigua and Barbuda: the third paragraph in “Having seen” should read “niño, niña y adolescentes” in order to maintain the gender approach.  

Agreement no. 2 with “The University of West Indies”: the “Having seen” paragraph should read “problemas que afectan a la niñez de las Américas” instead of “los problemas que afectan a los niños en las Américas”.  

Agreement no. 9 Project 24534 – Proposed design of the IIN Strategic Plan on Communication: in page 4 the acronym “IIN” is always written with double “N”.   

2.      Comments on the English version of Agreements  

Agreement no. 1 with the “Directorate of Gender affairs, Ministry of Labour, Public Administration and Empowerment (DOGA) of Antigua and Barbuda: 

First clause:

Article 1. “Every” instead of “all”,  “referring” instead of “namely”, insert “the” before “family”.

Article 5.  Include “and” before “based”.  

Second clause:

Article 7. The right term is “depository”.

Article 8. Insert “by” before “installation”.

Article 9. Replace “cities” by “places” and use “except” instead of “excepting”

Article12. It should end with “in part”.

Article 15. Replace “fluent” by “smooth”.  

Final provisions

In the first paragraph, replace “with a first renewal” by “UIT a first expressed”  

Idem in the second paragraph, use “expressed”  

Agreement no. 2 with “The University of West Indies”  

Third initial paragraph. Include “AND” WHEREAS  

Delete “Now” from the expression NOW THEREFORE  

Second Article, paragraph a. Use “systematize” and the right name of the Convention - “Convention on the Rights of the Child”  

Paragraph c. It should have been worded as follows: “to diffuse within Jamaica all information on children and the family generated in this country, as well as are information received by the IIN from the rest of the Americas and the documentation which does not originate in the Inter-American System but which directly or indirectly contributes to improving the quality of life of Jamaican children, and families”.  

Paragraph d. Delete “in order” and replace “information available for all users” by “information available to all user”  

Paragraph e. Insert “the” before “users”.  

Third clause, paragraph a. Use the term “royalty-free”  

Paragraph d. Use “programmes” instead of “programs” and insert “the” before “family” at the end of the sentence.

Paragraph f. Use “programmes for which the UWI....”

Paragraph h. Delete “st” at the end of the word “among”

Paragraph i. Delete “the” before “information”

Paragraph k. Use “the user” instead of “usufructuary”  

Article 5. Use “programmes” instead of “programs”  

Agreement no. 3 - Consejo Nacional para la Niñez  y la Adolescencia  (CONANI) 

In the second “Considering” paragraph replace “permanently” by “always”.  

The end of the second to last “Considering” paragraph should read “… ensuring comprehensive protection for the child.”  

The last “Considering” paragraph should read “…. on the situation on the child”  

Article One – Objetives. The format of objective a) should be modified and it should also read “… actions aimed at the children”  

Paragraph b) should read “….. agreements between both organizations …” and end with “… from either party”.  

Article Two - Execution, paragraph b). Replace “programs” by “programmes”.  

The end of Article Four should read: “…. expressed request of either party”  

Paragraph… instead of “though” should read “by” and instead of “governed” it should read “bound”  

Addendum to the General Cooperation Agreement between the CONANI and the IIN “Support for Monitoring the Enforcement of Children’s Rights (SMD)   

Both “Article Two” and “Article Three” should read “agrees” instead of “engages”.  

Addendum to the General Cooperation Agreement between the CONANI and the IIN, Books, Videos and Teaching Kit for the Promotion of Children´s Rights  

The end of the second “Considering” paragraph should read “… comprehensive child protection in the agenda of national priorities”  

Fifth “Considering” paragraph. Replace “addressed to” by “aimed at” and then insert “with a comprehensive Protection approach ….”  

The last “Considering” paragraph should read “text on the Convention”.  

Article 1 should read “… on a compact disc”  

Article 4: format should be changed.   

Articles 6 and 7 should read “agrees” instead of “engages”  

Article 8 should read “…. Director General of the IIN, while keeping the logos”  

Article 9: format should be changed.  

Article 11 should read “agrees” instead of “engages”.  

Addendum Coordination Site for Chile-related Actions (CA Site)  

The format of Article 3 should be revised and it should read “…. Activities of the CA Site those parties involved namely,…”  

Article 4: brackets should be included after (24)  

Article 5 should read “….. to use the CA Site or its databases. Any child related information…..” and delete the word “definitely”.

Agreement no. 4 with Save the Children, March 2006.  

Second “Considering” paragraph: replace “watching over the” by “ensuring”. Third paragraph: use “always” instead of “permanently”.  

Fifth paragraph: replace “children´s integral protection” by “the comprehensive protection of children”, and use “neglect” instead of “negligence”.  

Sixth paragraph: delete “as web” and replace “providing” by “which provide”, include a comma after “definition” and delete “and”.  

Article 1, Objectives, paragraph a: replace “addressed” by “aimed at”  

Article 2, Implementation: replace “engage” by “agree”; paragraph a: use “human resources other forms of contribution, the justification”. Paragraph c: use “programmes” instead of “programs”.  

Article 3, Final Provisions: replace “Nevertheless, any Party” by “Nevertheless, either Part”  

Agreement no. 5 with the Consejo Nacional de Atención y protección Integral a la Niñez y la Adolescencia (CONAPINA) 

Article 1. Replace “programs” by “programmes” and “to improving” by “at improving”

Article 4. Insert “at its headquarters” at the end of the paragraph.

Article 5. Replace “addressed” by “aimed” and delete “themselves”.

Article 6. Replace “videogames” by “video-games”  

The standardization of the terms “Centres” and “Centers” is suggested for their proper application. 

Agreement no. 6 with CIDETT

Third “Considering” paragraph: use “always” instead of “permanently”. Fifth paragraph: replace “Children´s integral protection” by “protection of all children”. Sixth paragraph: use “cooperation aimed at developing policies” and replace “providing” by “which provide”

Article 2, Implementation:  use “agree” instead of “engage”. Paragraph a: use “human resources, and other forms of contributions”. Paragraph b: replace “programs” by “programmes”

Final Provisions: replace “any Party” by “either Party”.

Agreement no. 7 with Defence for Children International

Throughout the document replace “programs” by “programmes”.

Second “Considering” paragraph: replace “watching over the” by “oversee”. Third paragraph: replace “permanently” by “always”

Fifth paragraph: replace the concept “children´s integral protection” by “the comprehensive protection of children”.

Sixth paragraph: replace “systems providing” by “systems which provide”

Article 1, Objectives - Paragraph a: use “at promoting” instead of “to promoting”, and “overseeing” instead of “watching over”.

Article 2, Implementation: use “agree” instead of “engage”. Paragraph a: use “human resources, and other forms of contributions”. Paragraph b: replace “programs” by “programmes”

Final Provisions: replace “any Party” by “either Party”

Agreement no. 8 The Hague Conference

Second “Considering” paragraph: replace “monitoring” by “monitor”. Number 2: delete “currently”

Article 1, Purpose - Paragraphs a. and b: use “programmes” instead of “programs”. Paragraph c: use capital letters in Memoranda of Understanding.

Replace “programs” by “programmes”.

Article VII should read “If any such....” instead of “If such any such …..”

Agreement no. 9 - Cooperation Agreement between Save the Children Sweden and the Inter-American Children’s Institute.

The end of 2) Background, should read “The general purpose of this Agreement is to assist in creating the adequate ….” and use “favour” instead of “favor”.

3) Scope of the Agreement, should read “Project 24604 – “Comprehensive Study ...”

Annex 6 should be entitled “Ethical guidelines”

5.2.1 should read: “ …. Amount of one hundred and forty thousand, four hundred and 00/100 Swedish Crowns SEK 140,400.00

The name of the Project should be: “Project 24604 – “Comprehensive Study ...”

Article 5.2.5 should read “….. the IIN in any exchange with similar programmes …”

5.3.7, Contribution should be in lower case. It should also read “….to such Contribution shall be subject to an IIN ….”
