AGREEMENT FOR THE TRAINING PROGRAM SIGNED BETWEEN THE PONTIFICIA UNIVERSIDAD JAVERIANA AND THE INTER-AMERICAN CHILDREN'S INSTITUTE

This agreement, which is subject to the clauses herein below, has been held between the undersigned, namely MARÍA CRISTINA RUIZ, domiciled in Bogotá, identified with the Certificate of Citizenship number 63,284,722 of the city of Bucaramanga, who is acting as Special Official Representative on behalf of and representing the PONTIFICIA UNIVERSIDAD JAVERIANA, a non-official non-profit institution of higher education officially acknowledged by Resolution 73 of the Ministry of Government passed on the 12th of  December of 1933, acknowledged as a University by Decree number 1297 passed on the 30th of May of 1964, overseen by the COLOMBIAN INSTITUTE FOR THE PROMOTION OF HIGHER EDUCATION (ICFES), with its headquarters located in Bogotá, and in accordance with the special authorization given to her by the Official Representative of the Pontificia Universidad Javeriana through deed number 2016 from September 30, 1998 signed in the notarial office 26 of Bogotá, which will be hereinafter called THE UNIVERSITY, this being one party, and the other party being ALEJANDRO BONASSO, domiciled in Montevideo, Uruguay, identified with the identity card number 807,357-8, who is acting as DIRECTOR GENERAL of the Inter-American Children’s Institute, a special body of the Organization of American States (OAS), which will be called the IIN throughout this agreement, and Yasmín Elina Serrada, a student in her 9th semester in Political Sciences, of legal age, identified as it appears at the bottom of her signature, which will be hereinafter called THE STUDENT

FIRST. OBJECTIVE: By this agreement the IIN commits itself together with THE UNIVERSITY, and especially with the School of Political Sciences and Diplomacy, to provide THE STUDENT with all the resources needed to receive professional, methodical and complete training for the program herein stipulated. 

SECOND. With this purpose the IIN will provide the student with the facilities, tools, elements and office equipment which are required for the compulsory training, without which THE STUDENT would be prevented from obtaining the degree that she aims for. 

THIRD. Considering THE STUDENT’S main professional interest, she will undergo training in the field of analysis and research corresponding to her knowledge and skills. The IIN will be able to place THE STUDENT in the suitable field and in a training area according to her main professional interest. 

FOURTH. During the training period the IIN will commit itself to cooperating with the Tutor appointed THE UNIVERSITY for the training, in order to fulfil its functions of consultancy and evaluation THE STUDENT in the corresponding field.

FIFTH. Both supervision and management of this agreement are the responsibility of THE UNIVERSITY’S School of Political Sciences and Diplomacy, which will offer the student permanent consultancy through the work of the Tutor and the IIN, which will appoint an official to be THE STUDENT’S immediate coordinator, who will be responsible for guiding THE STUDENT through the fulfilment of the required training program. PARAGRAPH: Periodical evaluations will be carried out during the semester according to a schedule. 

SIXTH. THE STUDENT will be academically subject to THE UNIVERSITY and her only connection to the IIN will be for training purposes, without working ties, unless this is specified by the IIN. 

SEVENTH. According to law THE STUDENT declares that she knows her obligation to join the Social Security Health System, a requirement that should be fulfilled before registration and that THE STUDENT must keep current during the training. THE STUDENT will not be entitled to personally or legally demand- either herself or through a third party- any monetary compensation or payment in kind as a result of any illness or accident that might occur during her training in the IIN. 

EIGHTH: THE STUDENT, who is an integral part of the Universidad Javeriana’s community is committed to the following, as a future professional graduated from the School of Political Sciences and Diplomacy, and given the context of Colombian institutions’ legal and ethical regulations: 

-The fulfilment of certain specified tasks in the field stated in the third clause, in order to comply with the training program required by the IIN, which is a requirement to obtain a professional degree.

-Complying with the rules and regulations established by THE UNIVERSITY and working diligently to achieve the best performance during his training.

-Arriving on time at the place where the training will take place and complying with the regulations of the IIN in her capacity of trainee.

-Keeping in the strictest confidence anything concerning the subjects and cases being dealt with by the Inter-American Children’s Institute (state body’s full name)

-Not violating INJUV’s copyrights on the documents that are developed during the training that takes place in that institution. Despite this, students are, according to law and international treaties, entitled to any rights that they might have as authors or coauthors of these documents. 

NINTH. The parties signing this agreement explicitly acknowledge the fact that the IIN is committed to giving THE STUDENT the opportunity of undergoing training for hereducation as a professional, and that no obligations apart from those explicitly stated in this document derive from this commitment. 

TENTH. The training period will last eighteen weeks starting from the 27th July 2002. This period will be divided into working days lasting four (4) hours (part-time) or eight (8) hours(full-time), which will be established by the firm. For the purposes of this agreement THE STUDENT will be considered as working full-time. 

ELEVENTH. After the training period has finished, the IIN commits itself to taking the necessary steps concerning the assessments of performance, which will be carried out considering the specific format submitted by THE UNIVERSITY. This task will be carried out through the work of THE STUDENT’S immediate coordinator, in order to assess THE STUDENT’S progress. 

TWELFTH. The result of the training period will be assessed by conducting two (2) partial reports and one (1) global report that THE STUDENT will submit to the Tutor affiliated to the respective field in THE UNIVERSITY, and by taking into account the results stated by the IIN in the assessments of performance, with their specific format. Academic evaluation is to be carried out solely by the Tutor appointed by THE UNIVERSITY, and should be based on monthly reports submitted by the student and the IIN. 

THIRTEENTH. The following are grounds for ending this agreement: 

-         Failure to fulfil the obligations stated heretofore.

-         Any kind of immoral or criminal act, as well as any act of proven irresponsibility that THE STUDENT would commit.

-         Failure to find THE STUDENT in the area previously established, after THE UNIVERSITY having provided proof of this.

-         The parties’ mutual consent. 

FOURTEENTH. Unilateral finishing of this agreement on fair grounds, by the IIN, due to THE STUDENT’S failure to fulfil any obligations, her poor performance, or  lack of discipline, that THE STUDENT would fail to overcome, shall result in her failing the course for that particular semester, not having the right to any refunds regarding the previous payment of THE STUDENT’S enrolment fee. 

FIFTEENTH. The annulment of this agreement by the IIN, which were not based on fair grounds and would occur due to different causes than those stated in the fourth clause of the present agreement, will result in changing the training place designated for THE STUDENT. 

For the record, the foregoing the parties have signed this agreement in Bogotá, on the 20th day of August of the year 2002.
