ADDENDUM
No. 1
TO
THE
GENERAL
COOPERATION AGREEMENT BETWEEN CONSIDERING: That
the Inter-American Children’s Institute is a specialized organization of
the Organization of American States the purpose of which is raising an
alert awareness on problems affecting children in the Americas by means of
cooperation among the countries in the continent addressed to improve
living conditions of children, youth and the family in general in the
areas of health, education, and social, juridical and cultural aspects; That
the Secretaria Nacional de la Infancia y la Adolescencia (National Child
Secretariat) was created by Law 1680/01 within the framework of the Child
Code; That
since 1988 the Inter-American Children’s Institute has promoted the
Inter-American Child Information Network (RIIN) that includes three
databases (documents, organizations and projects); The
importance of cooperation between related organizations, especially within
the Inter-American System, for the purpose of achieving a greater and more
efficient utilization of their resources for the benefit of the countries
in the hemisphere which will contribute to developing the national
capability to meet the needs of children and their families; THEREFORE: The
Secretaria
Nacional de la infancia y la adolescencia
(hereinafter SNIA) and the Inter-American Children’s Institute
(hereinafter the IIN) agree to establish a National Child and Family
Information Center (hereinafter the Center) which will be a RIIN focal
point and will act as the Coordinating Center of the National Child and
Family Information Network in Paraguay. SECTION
ONE
Objectives
The Center, as the first step of the National Network, will have
the following objectives:
Article
1 To compile, select and systematize all the
information and documentation produced in Paraguay concerning children and
the family in the juridical, social, educational, drug prevention and
health areas following the Convention on the Rights of the Child as a
reference. Article
2 To
compile, select and systematize all references concerning institutions,
projects and events related to the areas defined in Article 1. Article
3 To
disseminate in Paraguay the information on children and the family
produced in the country as well as the information from the rest of
America obtained through the IIN and the documentation external to the
Inter-American System which may contribute, either directly or indirectly,
to improve the living conditions of Paraguayan children and families. Article
4 To make
any information and documentation compiled by the Center periodically
available to the Information and Coordination Center of the IIN
(hereinafter the CIC) for the purpose of updating common databases and
sharing it with all the users of the System in the region. Article
5 To make
available to the users in Paraguay and the users of the RIIN Network in
the region copies of the original documents according to the mechanisms
agreed upon with the IIN. SECTION
TWO Terms
of the Agreement Article
1 The IIN
will make available to the SNIA, as a “User License”, the OPD System
especially designed by the IIN as well as the relevant documentation.
Article
2 The IIN
will provide the training and technical support contributing to the
adequate operation of the Center. Article
3 The SNIA
will provide the adequate infrastructure for the operation of the Center. Article
4 The SNIA
will be responsible for providing the personnel required for the adequate
operation of the Center and for preserving the child and family-related
software and information in the OPD System. Article
5 The SNIA
will afford the installment, training and maintenance of the Center by
creating the conditions required for ensuring its operation beyond the
initial 24-month period. Article
6 The SNIA
may create a National Network based on the Center in the other Paraguayan
cities by concluding agreements with those institutions deemed pertinent.
This Agreement will apply to those institutions as well, except for
software support and maintenance which in such cases will the
responsibility of the SNIA. Article
7 The SNIA
will keep the IIN informed on Center-related activities as well as on the
creation of new nodes. Article
8 The SNIA
will produce an annual version of the Child Yellow Pages and a Project
Guide that will be distributed among Paraguayan users. Article
9 The SNIA
will be responsible for any information included in the Paraguay system,
but will not be responsible for the information included in the system by
other National Centers, nodes, or by the CIC itself. Article
10 The SNIA
may copy or transfer the system information to use it in its own
databases. Article
11 The SNIA
will connect to Internet in order to count on electronic mail, electronic
conferences and database access services allowing for a fluent exchange of
information with other Centers in the Inter-American Child and Family
Information Program - PIINFA, as well as for the access of user
institutions to on-line queries. Article
12 The SNIA
will ensure the continuity of the human and material resources allocated
to this project in order to meet the obligations provided for in this
Agreement. SECTION
THREE Final
Provisions This
Agreement will come into force upon its signing by the parties involved
and will be valid for a 24-month period that may be renewed subject to the
previous assessment of the IIN. The first renewal will be explicit and
further renewals will be automatic for 24-month periods each. This
Agreement will be terminated at the request of one of the parties with a
90-day prior notice. In such case, the Information Center should not keep
using the programs and databases which should be returned to the IIN. The
terms of this Agreement may be amended subject to the prior consent of
both parties. In
