THE
INTER-AMERICAN CHILDREN’S INSTITUTE (IIN), a
Specialized Organization of the Organization of American States (OAS)
—hereinafter named as THE IIN or with its full name for the
purpose of this Agreement—, duly represented by Julio Rosenblatt,
bearer of OAS passport No. 27495, and THE
CONSEJO
NACIONAL PARA LA NIÑEZ Y LA ADOLESCENCIA (CONANI) (NATIONAL CHILD
COUNCIL), a decentralized agency of the Dominican State created by
Act 136-03 that established the Code for the Protection of Child Basic
Rights — hereinafter named as THE
CONANI or with its full name for the purpose of this Agreement—
domiciled in Av. México Esq. 30 de
Marzo, Oficinas Gubernamentales, bloque D, duly represented by its
Executive President, KIRSYS FERNÁNDEZ
DE VALENZUELA, a Dominican national, of age, married, bearer of
identity and electoral card No. 001-0103222-5, domiciled in this city of
Santo Domingo de Guzmán, Capital City of the Dominican Republic. WHEREAS:
THE IIN is
a Specialized Organization of the Organization of the American States
created through a resolution adopted at the Fourth Pan American Child
Congress in 1924 and formally established in 1927 for the purpose of
promoting cooperation programs among the countries in the Americas aimed
to improving the health, educational, social, cultural and juridical
conditions of children and the family. CONSIDERING:
That searching for effective solutions to problems affecting children and
consequently watching over the compliance with and enforcement of the
Convention on the Rights of the Child is a priority issue for THE
IIN. CONSIDERING:
That
since its inception THE IIN has
permanently developed actions of technical cooperation, information,
dissemination and training on various child-related issues in the
Hemisphere, as well as joint activities with other public and private
agencies in the inter-American system. CONSIDERING:
That THE IIN has had an
active participation in the highest political fora in the region related
to children, the family and social policies.
CONSIDERING:
That the 2005-2008 Strategic Plan provides for a stronger cooperation
among related organizations in the region, a greater exchange of
knowledge, information and experience, and for developing and promoting
instruments that can be easily replicated. CONSIDERING:
That THE CONANI is a
decentralized agency of the Dominican State with legal capacity and its
own patrimony, as well as the administrative body of the National System
for the Protection of Children’s Rights, and is entitled to sign this
Agreement in its capacity as the highest authority in the System. CONSIDERING:
That THE
CONANI has, on behalf of the Dominican State, the irrevocable
obligation of adopting the administrative, legislative, judicial and any
other type of measures required to ensure all children throughout the
national territory the full and actual exercise of their basic rights. CONSIDERING:
That both organizations acknowledge the importance of ensuring child
integral protection. CONSIDERING:
That
both organizations recognize the need to create and consolidate national
and regional information systems providing data on child situation in
order to facilitate decision-making, policy definition and assessment, and
society awareness. In
the understanding that the above preamble is a part of this Agreement, the
Parties hereby AGREE: ARTICLE
ONE: OBJECTIVES. This
Agreement sets the general basis for the achievement of the following
objectives: a)
To ensure exchange and cooperation between THE
IIN and THE CONANI
concerning the development of policies and actions addressed to children
and the family in the Dominican Republic. b)
To establish the legal basis of further agreements among both
organizations in order to implement specific projects and actions
resulting from common concerns and at the request of cooperation from one
of both parties. ARTICLE
TWO: EXECUTION. In
order to achieve the objectives of this Agreement, the parties hereby
commit themselves to act along the following lines: a.
The development of specific projects will be implemented through
operational agreements where technical, financial, human and any other
contributions will be broken down, and where the justification of specific
projects and every element ensuring the adequate compliance of terms
agreed upon will be detailed. b.
As far as necessary, the parties will create working groups to
study the nature, depth and scope of programs and activities to be
implemented within the framework of this Agreement and the relevant
projects. ARTICLE
THREE: COOPERATION PATTERNS. The
areas for exchange and cooperation will be determined by THE
IIN and THE CONANI and will
be framed in the Strategic Plan of THE
IIN, notwithstanding other cooperation areas to be jointly agreed upon
by THE CONANI and THE IIN ARTICLE
FOUR: FINAL PROVISIONS. This
Agreement will enter into force upon the signature of both parties and
will be valid for four years, and may be either extended for a similar
period or amended at any time at the express request of any of both
parties. PARAGRAPH:
This Agreement may be terminated through a ninety-day written
notice, but such termination will not discontinue the ongoing projects
that are governed by its specific provisions.
IN
WITNESS THEREOF, the
representatives of both PARTIES, duly authorized for this purpose, hereby
sign this Agreement in two equally valid copies on the twenty-fist day of
October, 2005.

That on October 21st, 2005 the Consejo
Nacional para la Niñez y la Adolescencia (CONANI) and the
Inter-American Children’s Institute (IIN) have signed a General
Cooperation Agreement where Article One provides for further agreements.
CONSIDERING:
That in August 2005 an Agreement was signed between the former Consejo
Nacional para la Niñez (CONANI) and THE IIN for creating the National
Child and Family Information Network in the Dominican Republic. In
the understanding that the above preamble is a part of this Agreement, the
Parties hereby AGREE: SINGLE
ARTICLE: THE CONANI and THE IIN agree to renew the above
mentioned Agreement and proceed with actions related to the activities of
the National Child and Family Information Center and the Information
Network that is already operational in the country. In
witness thereof, the representatives of both PARTIES, duly authorized for
this purpose, hereby sign this Addendum in two equally valid copies on the
twenty-fist day of October, 2005.

ADDENDUM
TO THE THE

That on October 21st, 2005 the Consejo
Nacional para la Niñez y la Adolescencia (CONANI) and the
Inter-American Children’s Institute (IIN) have signed a General
Cooperation Agreement where Article One provides for further agreements. CONSIDERING:
That THE IIN has developed, within the framework of a cooperation
agreement signed with Save the Children – Sweden, a working tool
composed of an information methodology and system —Support
for Monitoring the Enforcement of Children’s Rights –SMD 1.0— for
the purpose of facilitating basic data collection for preparing the report
to the Committee on the Rights of the Child. CONSIDERING:
That Article 432 in Act 136-03 that established the “Code for the System
of Protection of Child Basic Rights” in the Dominican Republic, as far
as the role of the President of THE CONANI is concerned provides
for the annual preparation of a progress report on Dominican children’s
rights. In
the understanding that the above preamble is a part of this Agreement,
both Parties hereby AGREE: ARTICLE
ONE: OBJECTIVES. THE IIN will make available the SMD 1.0 system
under a user license to THE CONANI which will be responsible for
coordinating in the Dominican Republic the actions required for compiling
information on the basis of the methodology developed by THE IIN. ARTICLE
TWO: THE IIN hereby engages to train and provide THE CONANI
staff technical support specifically related to the SMD and to deliver
every new version resulting from its upgrading. ARTICLE
THREE: THE CONANI hereby engages to share SMD information with
those agents involved in issues related to the Committee on the Rights of
the Child. ARTICLE
FOUR: This Addendum will enter into force upon the signature of both
parties and will be valid for twenty-four (24) months, and may be either
extended for a similar period or amended at any time at the express
request of any of both parties. In
witness thereof, the representatives of both PARTIES, duly authorized for
this purpose, hereby sign this Addendum in two equally valid copies on the
twenty-fist day of October, 2005.

ADDENDUM

Nacional para la Niñez y la Adolescencia (CONANI) and the
Inter-American Children’s Institute (IIN) have signed a General
Cooperation Agreement where Article One provides for further agreements. CONSIDERING:
That THE CONANI is an institution with an extensive background in
providing social assistance services to the most underprivileged sectors
and its official mission consists of becoming the leading institution for
the inclusion of child integral protection in the agenda of national
priorities. CONSIDERING:
That since its inception THE IIN has permanently developed actions
of technical cooperation, information, dissemination and training on
various child-related issues in the Hemisphere, as well as joint
activities with other public and private agencies in the inter-American
system. CONSIDERING:
That THE IIN has developed a series of instruments for
disseminating the Convention on the Rights of the Child by means of, among
others, videos, books, and videogames. CONSIDERING:
That THE IIN has edited three books on the Rights of the Child
addressed to children in an attempt to make them acquainted with their
rights and duties, with and Integral Protection approach and respect for
the basic principles provided for in the Convention. CONSIDERING:
That THE IIN has produced eight promotional videos on the rights of
the child. CONSIDERING:
That THE IIN has developed a teaching package including, among
others, books on the rights of the child, videos, a videogame, and the
text of the Convention. In
the understanding that the above preamble is a part of this Agreement, the
Parties hereby. AGREE: ARTICLE ONE: THE IIN will make available to THE CONANI in a compact disk
the graphics required for printing the books “Children and their
Rights”, “Children and their Rights within the Family”, and
“Children and their Right to have a Family”. ARTICLE
TWO: THE CONANI hereby commits itself to maintain the printing quality
standards of the original work and keep THE IIN informed on the
numbers issued and their distribution. ARTICLE
THREE: THE CONANI will be able to add its institutional logos —and
possibly those of sponsors— to the already existing logos. ARTICLE
FOUR: THE CONANI will make available to THE IIN five copies of
every issue. ARTICLE
FIVE: Graphics cannot be made available to third parties without the
prior authorization of THE IIN which owns the copyright of the
above mentioned publications. ARTICLE
SIX: THE IIN hereby engages to make available to THE CONANI
eight promotional videos on the rights of the Child in both Beta and DVD
versions. ARTICLE
SEVEN: THE CONANI hereby engages to disseminate the above eight
promotional videos without including any changes affecting their original
messages. ARTICLE
EIGHT: THE CONANI will be able to add its logo subject to prior
consultation with the Office of the Director General of THE IIN and
keeping the logos already existing on each video. ARTICLE
NINE: THE CONANI will be able to make the above mentioned videos
available to third parties under identical conditions. ARTICLE TEN: The
Inter-American Children’s Institute (IIN) will make available to THE
CONANI the above mentioned teaching kit upon signing this Addendum. ARTICLE ELEVEN: THE
CONANI hereby engages to replicate the teaching kit and to coordinate
its dissemination with the Office of the First Lady and the Ministry of
Education in order to achieve an issue exceeding 5,000 copies. In witness thereof, the
representatives of both PARTIES, duly authorized for this purpose,
hereby sign this Addendum in two equally valid copies on the twenty-fist
day of October, 2005.

ADDENDUM

That on April 6, 2004 THE
CONANI
and THE
IIN
signed an agreement where THE
CONANI
undertook
to input and update child-related information within the framework of the
objectives of the CA Site and in conformity with its legislation in force.
CONSIDERING:
That THE
CONANI
has stated its interest to renew the operation of the CA Site including
cases of child disappearance and the international abduction of children
by one of their parents and/or any other relative. In
the understanding that the above preamble is a part of this Agreement,
both Parties hereby AGREE: ARTICLE
ONE: To
continue the activities of the CA Site as per the rights and duties
provided for in the Agreement signed on April 6, 2004. ARTICLE
TWO:
THE CONANI will send to THE
IIN an annual report on the
impact of the CA Site actions and case resolution.
ARTICLE
THREE:
THE
CONANI will
include in the activities of the CA Site activities those sectors
specifically involved with it (Ministry of Foreign Affairs, Special Police
Unit, Supreme Court of Justice). ARTICLE
FOUR:
This Addendum will enter into
force once signed by the Parties and will be valid for twenty-four (24
months, and may be automatically extended for a similar period. ARTICLE
FIVE:
This Addendum may be terminated with a ninety-day (90) notice in writing
and thereafter THE
CONANI
will not be able to use neither the CA Site nor its databases, and any
child-related information will be made available to the Government and
definitely deleted from the Site. In witness thereof, the representatives of both PARTIES, duly authorized for this purpose, hereby sign this Agreement in two equally valid copies on the twenty-fist day of October, 2005.
