WHEREAS:
The
Inter-American Children’s Institute is a Specialized Organization of the
Organization of American States, responsible for promoting the development
of an alert awareness of the issues affecting children in the Americas
through cooperation among the countries of the Americas aimed at improving
the conditions of children, youth and families in terms of health,
education, and social, legal and cultural aspects in general;
The
International Catholic Child Bureau is an international NGO involved in
assistance and charitable work, established in 1948 under French law,
which promotes unconditional respect for children, their family, their
community, their culture and their religion, and the defense of children
who are victims of sexual and labor exploitation, street children,
children in prison, children affected by war, and children with
disabilities;
Since
1998, the Inter-American Children’s Institute has been running the Inter-American
Child Information Network (RIIN), which operates three databases (on
Documents, Organizations and Projects);
There
is great importance in cooperation between similar organizations,
especially organizations of the Inter-American System, aimed at the
greater and more efficient use of their resources to benefit the countries
in the hemisphere, which will contribute to the development of national
capabilities to respond to the needs of children and adolescents and their
families;
THEREFORE:
The Inter-American Children’s
Institute (hereinafter known as the IIN) and the International Catholic
Child Bureau (hereinafter known as the BICE) hereby agree to establish a
Child and Family Information Center at the BICE offices in Uruguay, to act
as a User Center for the services of the IIN Information and Coordination
Center.
CLAUSE
ONE
Objectives
The
objectives of this Information Center (User Center) shall be:
Article
1.
To compile, select and systematize all of the information and
documentation produced within the BICE’s activities for children,
adolescents and the family as regards legal affairs, social issues,
education, prevention of violence, prevention of drug abuse, and health,
with the Convention on the Rights of the Child as the framework of
reference.
Article
2.
To compile, select and systematize all of the reference information
on institutions, projects and events related to the issues mentioned in
Article 1, coordinating with the IIN Information and Coordination Center
to add this information to the OPD databases.
Article
3.
To send to the IIN Information and Coordination Center, on a
periodical basis, the information and documentation that it has compiled,
for inclusion in the common databases, to make them available to all of
the System’s users in the region.
CLAUSE
TWO
TERMS OF THE AGREEMENT
Article
1.
The IIN shall provide the BICE with a “User’s License” for
the OPD System which has been specially programmed by the IIN, as well as
the related documentation.
Article
2.
The IIN shall provide the training, instruction and technical
support necessary for the proper operation of the Center.
Article
3
The BICE shall provide the appropriate infrastructure for the
operation of the Center, as well as the necessary furnishings and
equipment (computer, photocopier) for the fulfillment of the objectives of
the present Agreement.
Article
4.
The BICE shall be responsible for finding personnel to ensure the
proper operation of the Center.
Article
5.
The BICE shall bear the costs of installation, training and
maintenance of the Center, to ensure the conditions for the operation of
same.
Article
6.
The BICE shall report Center-related activities to the IIN.
Article
7.
The BICE shall not transfer the computer software or the associated
documentation to third parties, nor sell, in whole or in part, the
information contained in the OPD System.
Article
8.
The BICE shall use an Internet connection for the purposes of e-mail,
e-conferences and
access to the databases, permitting a fluid exchange of information with
the other
Inter-American Child and Family Information Centers and allowing access by
user
institutions to online query services.
Article
9.
The BICE
shall ensure the continuity of the human and material resources assigned
to this project, so that they fulfill the commitments derived from the
present agreement.
CLAUSE
THREE
FINAL PROVISIONS
The
present Agreement shall enter into force upon its signature by the parties,
and shall be valid for a period of 24 months, renewable upon evaluation by
the IIN and the BICE. The first renewal shall be expressly agreed;
subsequent renewals shall be automatic, each for a period of 24 months.
This
Agreement shall be rescinded at the request of one of the parties, with
notification 90 days in advance. In the event of rescission, the BICE
shall discontinue its use of the programs and databases, which it shall
return to the IIN. Changes to the terms of the present Agreement may be
made with the specific consent of both parties.
The
present Agreement is signed by Dr. Juan Pablo Monteverde, BICE Project
Coordinator, and Lic. Alejandro Bonasso, Director General of the IIN, in
the city of Montevideo on June 2, 2004.
