GENERAL
AGREEMENT OF COOPERATION |
The Inter-American
Children's Institute (from now on "IIN"), represented by its
Director General Lic. Alejandro Bonasso and
The Latin American Center on Human Economy, University Institute
CLAEH of Montevideo, Uruguay (from now on "CLAEH") represented
by its President, Dr. Romeo Pérez Antón.
Sign the present General Agreement of Cooperation subject to the
following Considerations and Clauses:
CONSIDERING:
That the IIN is a specialized organism of the Organization of
American States (from now on "OAS") created by resolution of the
Fourth Pan-American Congress of the Child of 1924 and founded in 1927 to
promote programs of cooperation among the countries of the Americas in
order to improve the living conditions of children, adolescents and
families in aspects of health and education as well as social, cultural
and juridical life, among others;
That it is a priority of the IIN to search for effective solutions
to problems affecting children as well as to insure the fulfillment and
application of the Convention on the Rights of the Child in cooperation
with the Member States of the OAS and society as a whole;
That since its foundation, it has developed training programs,
technical cooperation, information and dissemination programs on topics
related to children in the hemisphere as well as worked in joint
activities with other organizations of the inter-American system and
public and private institutions;
That the IIN has been working intensely on technical cooperation
with the countries of the Americas in promoting the rights of children and
adolescents;
That it has been acknowledged the interest and the need to improve
training for professionals working in the different fields related to
children and adolescents;
That the IIN has developed the Inter-American Project of Higher
Learning which tries to respond to such a need as well as to create
mechanisms of horizontal cooperation among the Universities of the
Americas which offer post graduate courses.
That CLAEH is an Uruguayan institution founded in 1957, devoted
since its inception to research in social sciences and to the promotion of
development and coordination of those involved. More recently it has been
recognized by the Uruguayan Ministry of Education as a University
Institute devoted to academic formation in the post graduate and masters
area. It offers programs on Social Policies, Local Development,
Environment Management, Economy and Management of Health, Contemporary
History, Mercosur Integration and Communication. For the last 25 years it
has been publishing the CLAEH notebooks, the oldest circulating magazine
of Social Sciences both in the country and in the region;
That both organizations acknowledge the need and mutual interest in
developing joint projects in the area of university formation, reciprocal
assistance and technical cooperation with the countries of the Americas in
promoting the rights of children and adolescents within the framework of
the Convention on the Rights of the Child;
That the IIN has the authority to sign agreements for the execution
of projects of technical cooperation under the norms, resolutions,
executive orders, rules and operating procedures adopted by its Statutes
and the Directing Council of the IIN;
AGREE
ON THE FOLLOWING:
ARTICLE
I
PURPOSE
The purpose of the present Agreement is to set the general rules in
order to achieve the following objectives:
a.
Coordinate the planning and execution of activities related to the
training of university professionals or college graduates through Seminars
and Specialized Programs in areas of Social Policies on Children and
Adolescents.
b.
Establish the legal framework for specific projects in this area
that are of common interest for both PARTIES.
ARTICLE
II
AREAS OF COOPERATION
The
areas in which CLAEH and the IIN will cooperate jointly will be agree upon
based on the individual and joint experience of CLAEH and the IIN and in
the interest expressed by other people or institutions in participating in
their programs.
Without prejudicing the above, the PARTIES agree on working jointly
in the following areas of cooperation:
a.
Training of university professionals and college graduates in
academic areas related to the rights of children and adolescents.
b.
Compilation, Creation, Dissemination and Promotion of Information
on the topics related to the Agreement.
c.
Development of pilot academic experiences in the specific area of
the Agreement.
ARTICLE
III
WAYS OF COOPERATION
In order to achieve the cooperation established in Article II, the
PARTIES can adopt different modalities depending on their purposes, giving
special consideration to the:
a.
Cooperation and technical advice jointly or individually for the
development and execution of projects and activities;
b.
Lateral coordination of the activities through missions, permanent
electronic communication or other means considered appropriate;
c.
Dissemination of information on the topics of the Agreement;
d.
Mutual assistance in human and financial resources through the
exchange of specialists or the allocation of funds to fulfill the
objectives of the Agreement.
ARTICLE
IV
EXECUTION OF THE AGREEMENT
For the execution of the present Agreement, as much as possible and
feasible, the PARTIES will observe the following guidelines:
a.
The higher authorities of each of the PARTIES, or whomever they
delegate, will keep official and permanent contact;
b.
According to paragraph b. of Article I, the execution of specific
projects will be governed by means of Memorandums of Understanding that
would specify in each case the objectives, activities, forms of
participation, obligation of the PARTIES; technical, financial and human
resources contributions of each; budgets and financing including the
corresponding indirect administrative and technical costs and all other
elements that would assure the normal and proper fulfillment of what was
agreed upon. Such memorandums of understanding will be signed - on the
part of the IIN - by the Director General and will not require the
approval of the Directing Council of the IIN.
c.
When judged necessary, the PARTIES can select technical groups or
missions to study and appraise the nature, intensity and extension of the
programs, projects and activities carried out or that could be carried out
under this Agreement by means of specific agreements of execution and
d.
The referred to specific agreements of execution could be done with
the participation of other organizations of technical cooperation and
financial help or the participation of the Government of countries
interested in the project or private institutions who share objectives
with the PARTIES if considered appropriate and necessary.
ARTICLE
V
MODIFICATIONS
The PARTIES, if commonly agreed, could modify the terms of this
Agreement provided that it is done in writing.

VI
COMING INTO FORCE AND DURATION
The present Agreement will come into force when signed by both PARTIES and will last for an indefinite period of time. Nevertheless, any of the PARTIES could rescind it by written notification and justification to the other party. The termination will take effect six months after reception of this notification. The termination of the Agreement will not affect the progress and conclusion of projects being carried out at the time.
IN WITNESS THEREOFF, the duly authorized representatives of both
PARTIES sign the present Agreement with two copies of equal value in the
city of Montevideo, Uruguay, on the 27th of July of the year
2002
